Effective March 21, 2022, the EPA announced a change in policy and enforcement of the 2010 Lead-Based Paint Renovation Repair and Painting (RRP) Rules for property management companies. Previously, any property management company that employed their own in-house maintenance teams were required to follow lead-safe work-practices in pre-1978 buildings. Fines for non-compliance could be as much as $37,500 per violation.

This 2022 revision stipulates that any Property Management Company who:
• Solicits bids or pricing from a vendor,
• Chooses a vendor,
• Gives the vendor access to the property, or
• Pays the vendor
is effectively acting similar to a General Contractor and now share the same responsibility and liability as a General Contractor has for the work and compliance of their sub-contractors.

This greatly expanded the liability for property management companies, even if they only hire outside vendors and do not do any of the maintenance or renovation work in-house.
